ELIGIBILITY: NC TIGERS AUSTRALIA raffle (“Raffle”) is open to citizens and permanent resides of the United States only. Only entries with valid United States contact information before the draw are eligible. Raffle promoters and/or NC TIGERS are not responsible for lost or stolen entries. Raffle entries will be disqualified, in the sole discretion of NC TIGERS, if attempts are made to disrupt the Raffle or circumvent the terms and conditions of these Official Rules. If the above occurs, NC TIGERS reserves the right to remedy any such action, disruption, or circumvention in a manner, determined solely by NC TIGERS that is fair and equitable to Raffle participants. RESTRICTIONS: NC TIGERS reserve the right to not award the prize if any or all of the following occur (i) Less than 400 tickets are sold at the time of drawing (ii) Prize has appreciated to a value beyond US$4000 (iii) Any or all Official Rules have been violated or the appearance of such violation is present. If no prize is awarded, every effort will be made by NC TIGERS to refund any and all monies paid to NC TIGERS, or, at the discretion of NC TIGERS award the winner a travel voucher for US$3500. PRIZE: The Raffle Numbers and Prize are not transferable or assignable and they are not redeemable for cash. All winners are responsible for the payment of any and all taxes and/or licenses and/or other related local, State, Federal fees that may apply to such winnings. Taxes on prize are solely the responsibility of the winners. NC TIGERS reserves the right to replace the advertised prize with a prize of equal or greater value if the advertised prize is no longer available. NC TIGERS will not be responsible for replacing any lost or stolen elements of any prize package. Accommodations will be at least of ‘three star’ quality and selected by the NC TIGERS with sole discretion. WINNERS: Winners will be selected by a random drawing from among all eligible entries received. A random drawing will be held under the supervision of NC TIGERS. The random drawing will occur January 26 2010. All decisions by NC TIGERS are final and binding. Winners will be notified by e-mail, telephone or mail, which notification will be determined in the sole discretion of NC TIGERS. The winner may be required to provide NC TIGERS with proof that he or she is the person identified on the winning ticket. CONDITIONS: By entering, participants agree to be bound by these complete Official Rules and the decisions of NC TIGERS, which shall be final. NC TIGERS and its members, officers, supporters, agents, and representatives and their parent companies, affiliates, subsidiaries, and advertising, promotion and legal advisors are not responsible for and shall not be liable for: (i) late, lost, delayed, damaged, misdirected, incomplete, illegible, or unintelligible entries; (ii) failed, returned, or misdirected notifications based on inaccurate information provided by the winner; or (iii) telephone, electronic, hardware, or software program, network, Internet, or computer malfunctions, failures, or difficulties resulting from participation in this Raffle of otherwise; (iv) errors in transmission; (v) any condition caused by events beyond the control of NC TIGERS that may cause the Raffle to be disrupted or corrupted; (vi) any injuries, losses, or damages of any kind caused by a prize or resulting from acceptance, possession, or use of a prize, or from participation in the Raffle; or (vi) any printing or typographical errors in any materials associated with the Raffle. RELEASES: By participating, entrants agree that NC TIGERS, those involved in the development, production, implementation and distribution of this promotion shall not be liable for any and all claims, damages, losses or injuries, including any third party claims, arising from or relating to, in whole or in part, this Raffle, including entry and participation in this Raffle and acceptance, possession, use or misuse of the prize. All entrants further agree that in the event of any third party claims, damages, losses or injuries, arising from or relating to a participant's entry or participation in this Raffle, they will indemnify NC TIGERS from any and all such claims, including the attorneys' fees related thereto.
